Filing Fees: Varies.

The filing fee is a cost for filing a bankruptcy petition; the fee is set by the court and it is periodically adjusted. The amount of the filing fee depends on the type of bankruptcy petition you file. Additionally, this fee is paid to the bankruptcy court when we file your case. No portion of this fee is paid to the attorney. The current filing fees are as follows:

  • Chapter 7 Filing Fee: $338.
  • Chapter 13 Filing Fee: $313.
  • Chapter 12 Filing Fee: $278.
  • Chapter 11 Filing fee: $1,738.

Attorney Fees.

This is the cost associated with having an attorney prepare and handle your bankruptcy case. The attorney fees vary depending on the type of bankruptcy case that you need to file.

  • Attorney Fees for Filing a Chapter 7 case: $2,162. For a Chapter 7 case this is typically a flat fee and it is paid before we file your case. This fee does not include representation if a third party initiates an adversary proceeding against you since this is not a normal part of your bankruptcy. In the event of an adversary proceeding, you have the option of hiring us to represent you, or you can hire another attorney of your choice.

  • Attorney Fees for Filing a Chapter 13 case: Hourly Billing & Retainer: $425 per hour together with a $2,500 retainer. A Chapter 13 case is more dynamic and more complex than a Chapter 7 case. A Chapter 13 case also lasts anywhere from three to five years and may need to be adjusted to accomodate changes in a person's life. For those reasons we opt to charge an hourly rate and require a retainer. Any portion of the fees that exceeds the retainer is paid to the firm through the chapter 13 plan after court approval.

  • Attorney Fees For Filing a Chapter 11 or 12 case: Hourly Billing at $425 per hour & Retainer (amount various depending on the facts of your case).

Other Fees & Costs.

  • Conversions. Converting a case from Chapter 7 to Chapter 13 is free of charge whereas converting from a Chapter 13 to Chapter 7 incurs a fee of $25. There is a fee for most other chapter conversions.

  • Amendments.Any amendments to Schedules D, E, and F cost $34 per amendment. Changes to the master mailing matrix also cost $34 per amendment. For that reason, it is important to ensure you have disclosed all of your creditors to your attorney prior to filing.

  • Reopening Cases. In the event that it is necessary to reopen a closed case the costs are $260 for a Chapter 7 case, $200 for a Chapter 12 case, and $235 for a Chapter 13 case. The cost for reopening a Chapter 11 varies.
